Kamal Farouque is a Principal in the Employment & Industrial
Law practice with extensive experience in employment,
discrimination and workplace law.
This year Kamal was nominated as recommended among Victorian
employment and industrial awyers by
Doyle's legal list 2011.
He has an in-depth understanding of the legal and practical
aspects of employment law and knows how to navigate the myriad of
issues in this increasingly complex and ever-changing area of
law.
Kamal advises employees, including senior executives, on
employment issues relating to contract negotiation, redundancies,
termination, discrimination and disciplinary matters. He negotiates
directly with employers to resolve issues on terms favourable to
his clients.
He also has experience in conducting litigation in courts and
tribunals including the Federal Court, the Supreme Court, the
Magistrates Court, industrial tribunals and discrimination
tribunals.
Examples of Kamal's experience include:
- Representing a senior IT professional who had been dismissed by
a major bank for alleged misconduct. Kamal was successful in having
his client reinstated with a payment of over $100,000
compensation
- Representing Victorian police officers in a case before the
Magistrates Court and the Federal Court to recover a substantial
amount of unpaid allowances
- Representing the family of Larry Knight and the Australian
Workers Union in the six week coroner's inquest into the death of
Beaconsfield miner Larry Knight, and
- Representing the Wilderness Society in a case commenced by
Tasmanian logging company Gunns in the Supreme Court of Victoria.
The case against the Wilderness Society started in 2004 and was
resolved in 2009 with Gunns paying the Wilderness Society a net sum
of $325,000.
Kamal also has extensive experience appearing as an advocate
having practised as a Barrister at the Victorian Bar between 1999
and 2004. Whilst at the Bar, he focused on employment and workplace
law.
